like i pre-expected the protection is too stupid that it is depending on the window title of pre-specified targets including, CloneCD, NeroExpress, UltraISO and some others.
so by simply changing the window title of each program (or the one you have, DOH!) you have just defeated the protection..

oh, one more thing, the protection is included in a file named 'internae.exe' that can be found under your C:\Windows\System directory, this file is written in VB (quite no surprise! :p) and executed upon logon, so you must first terminate its process by pressing Ctrl+Alt+Del then choose internae.exe and hit "End Process".

now you can safely apply the patch. the patch also remodifies some registry values back to normal cause the protection executes a very stupid .reg file in the same directory which disables some CDBurning tools features like "Lock CD" under CloneCD.

WARNING: do another check on your CDBurning program settings, the internae.exe file runs before my patch so it's obviouse that it might disable some other features in your program.
